1) Who we are

(“we”, “us”, “our”). These terms govern your use of www.369brain.com (the “Service”).

2) What we do (prompt-only)

We provide a prompt-generation service: you answer short forms and the system generates prompts for you. The Service uses LLM as part of the generation process. We do not use your prompts/outputs to train our models at this time (if this changes, we’ll update our Privacy Policy and, where required, ask for consent).

When you paste a prompt into a third-party AI/LLM (e.g., an external chat tool), the resulting outputs are produced by that third party, not by us. We don’t control, endorse, or guarantee those outputs and we’re not responsible for any loss arising from their use. Your use of third-party services is governed by their terms and policies.

3) Accounts & eligibility

  • You must be 18+ to use the Service.
  • One account per person; do not share your login.
  • Keep your password secure; you’re responsible for activity on your account.
  • We may suspend or terminate accounts that breach these terms or our Acceptable Use Policy.

4) Plans, credits & free trials

  • You may buy credit packs or start a monthly subscription. Plan details (price, included credits) appear on each product page at checkout.
  • Use: 1 generation = 1 credit.
  • Expiry: credits expire 180 days after purchase; oldest credits expire first (FIFO).
  • Free trial: 5 free credits on registration (no card required). Your credit balance appears in your dashboard.
  • Subscriptions: auto-renew monthly until cancelled. You can cancel any time in your dashboard; service continues until the end of the paid period. No rollover; unused credits still expire 180 days after issuance.
  • Unless stated otherwise on the product page, no refunds on unused or expired credits (see Refunds & Cancellations).

5) Payments & billing

  • Payments are processed by Stripe; we do not store full card details.
  • Prices and what’s included are shown at purchase.
  • We are not VAT-registered.
  • Invoices/receipts are sent by email.
  • We may correct obvious pricing or description errors.

6) Your responsibility to verify & no professional advice

  • You must review and verify all prompts and any subsequent outputs before use. Prompts/outputs may be inaccurate, incomplete, biased, or unsuitable.
  • The Service does not provide medical, legal, financial, accounting, or other professional advice. If you need advice, consult a qualified professional.

7) High-risk & prohibited uses

Do not use the Service (or prompts/outputs) for:

  • medical care, diagnosis, or drug dosing;
  • legal or regulated financial services/advice;
  • safety-critical or high-risk environments (e.g., emergency services, life support, aviation, nuclear, military, critical infrastructure);
  • operating or controlling machinery, vehicles, robots, IoT or other physical systems;
  • illegal, infringing, harassing, deceptive, harmful, or adult/NSFW content.
    We may block specific words/categories and suspend accounts that breach these rules.

8) Availability & changes

The Service may change, be updated, or be temporarily unavailable for maintenance. We may update these terms; for material changes we’ll give reasonable notice (e.g., email or in-product). Continued use after the effective date means you accept the changes.

9) Third-party services

We integrate with Stripe, WordPress, WooCommerce, and Google Analytics. Their terms and privacy policies apply to their services.

10) Warranties & liability

The Service is provided “as is” and “as available.” We do not warrant accuracy, reliability, fitness for a particular purpose, or uninterrupted availability.

To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be limited.

11) Termination

You can stop using the Service at any time and cancel subscriptions in your dashboard. We may suspend or terminate your access for breach of these terms, the Acceptable Use Policy, or for security/legal reasons.

12) Governing law

These terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

Subscription & Credits Terms

1) Credit packs & usage

  • The number of credits and price for each pack are shown on the product page at checkout.
  • Use: 1 generation = 1 credit.

2) Expiry & order of use

  • Credits expire 180 days from purchase.
  • When you top up, the oldest purchased credits expire first (FIFO). Expiry dates are shown in your dashboard.

3) Free trial

  • 5 free credits on registration (no payment required).
  • We may limit to one trial per person/device/household and revoke trials in cases of abuse.

4) Subscriptions

  • Monthly, auto-renewing via Stripe/Woocommerce until cancelled.
  • Manage/cancel any time via your dashboard. Cancellation stops future renewals; access continues through the paid period.
  • No credit rollover between months; credits still expire after 180 days.

5) Immediate supply of digital content (consumers)

By purchasing credits or starting a subscription, you request immediate access to digital content. You acknowledge that you lose the 14-day cancellation right once supply begins. We present this clearly at checkout with a required checkbox.

6) Failed generations

If a generation fails due to a system error, we will automatically restore the credit where possible; otherwise contact hello@369brain.com.

7) Refunds

Unless otherwise stated on the product page, we do not refund unused or expired credits and we do not prorate subscription periods. See Refunds & Cancellations.


Refunds & Cancellations Policy

Last updated: 1st October 2025

  • Change of mind (digital content): Credits and subscriptions provide digital content/functionality immediately. Once supply begins, the 14-day cancellation right is lost.
  • Unused credit packs: No refunds for unused or expired credits.
  • Subscriptions: Cancel any time; cancellation takes effect at the end of the current billing period. No proration or partial refunds.
  • Billing errors / duplicates: Contact hello@369brain.com within 30 days. We’ll investigate and correct genuine errors.
  • Failed generations: We’ll restore the credit upon verification.
  • Statutory rights: Nothing here affects rights that cannot be excluded under applicable law.

Acceptable Use Policy

You agree not to use the Service to generate, upload, store, share or facilitate content that is illegal; infringes IP or privacy; is defamatory, harassing, hateful, discriminatory, or exploits minors; promotes violence, self-harm, terrorism or criminal activity; involves malware, phishing, spam; attempts to bypass security or rate limits; requests or contains highly sensitive personal data; or presents outputs as professional advice.

High-risk ban: No use in medical, legal, regulated financial, or other safety-critical contexts; no operation/control of physical systems.
Word/category blocking: We may block specific words or categories we consider prohibited or risky. Attempts to bypass filters (misspellings, obfuscation) are prohibited.
Enforcement: We may warn, restrict, suspend, or terminate accounts; remove or filter content; block terms; and cooperate with law enforcement where required.
